责任免除、风险承担以及赔偿协议

警示：请仔细阅读本文。本协议包含了一个法律责任免责条款，并将剥夺你向赛事组委会以及其他各方起诉的权利。除非你已经完整阅读本协议，否则请不要签字。如果你对本协议的法律效力并不清楚，请咨询你的法律顾问。

鉴于赛事组委会允许我参加于2024年11月8至9日期间，在厦门同安区举办的2024 Challenge Xiamen 厦门铁人三项挑战赛及赛事相关活动（例如赛道观光和健身用品及赞助商展会等），我谨代表我自己，并代表我的配偶、孩子、父母、监护人、继承人以及最近的血亲在此同意此“责任免除、风险承担以及赔偿协议”（“协议”），并据此作出如下具有合约性的法律声明：

我在此声明并同意，我个人应负全权的责任决定自身的身体状况是否足够健康到能够安全地参加铁人三项赛，且我在此证明我目前和将来的身体状况都足够健康，并经过足够的训练得以安全地参加我选择参加的铁人三项赛。我不具有任何身体或医学上的状况将危害到我的身体，如果我参加铁人三项赛的话，也不会影响到我安全参加比赛的能力。我完全明白和确认，在比赛前，比赛期间和比赛后使用酒精和/或药物所可能产生的危险和后果，我非常清楚使用酒精和/或药物将损害我的判断能力和/或运动能力。对于我使用酒精和/或药物所造成的或相关的任何人身伤害、损失或损害，我将承担全部的责任。

我非常明确和清楚铁人三项赛、铁人二项赛或其他多项目体育活动在身体或精神方面的严酷性，并清楚地意识到跑步、自行车和游泳以及其他该等比赛的组成项目在本质上是危险的，并且是对一个人身体或精神方面极限的极端测试和挑战。我明白，参加此项比赛可能意味着以下危险和风险，包括但不限于：身体严重伤害的可能性，永久性残疾，瘫痪和死亡，资产的损失和损害，暴露在极端环境和条件下，意外事故，疾病，与其他参赛者、观众、车辆或其他自然或人造物体的接触和碰撞，因恶劣天气而产生的危险，不完美的赛道条件，水、路面和地表的危险、设备故障，不充分的安全测试，不同参赛者不同的竞技水平，铁人三项赛的组织者不可控的情况，以及其他此处未做定义或未能预见的危险和伤害，以及其他目前未知的危险和风险（“风险”）。我明白，该等“风险”可能是全部或部分由于自身的作为或不作为，或铁人三项赛的其他参赛者的作为或不作为，或者本文下文定义的“被免责方”的作为或不作为或疏忽大意造成的，我在此明确声明，我将全部承担由于参加铁人三项赛而遭受的所有“风险”以及任何损失、损害、责任和费用。

我在此同意将熟知并遵守为铁人三项赛而设立的各项规则和规定，包括但不限于赛事组委会采用的《竞赛规程》。我同意，在参加此赛事前，我将检查比赛赛道，设施，设备以及使用的场地和区域。如果我认为或发现有任何地方不安全，我将立刻通知比赛总监。我同时还接受，我将对自己在参赛过程中的行为和举动，以及自有设备的条件和充分性负全责。

我在此免除以下各方的法律责任，承诺不对他们提起诉讼，并进一步同意对以下各方（“被免责方”）由于我参加铁人三项赛，和/或我来往于铁人三项赛途中(包括乘坐摆渡车往返机场、酒店或比赛现场的途中)而使他们遭受的一切索赔、诉讼、损害、损失（包括经济和非经济的）、费用（包括法律成本和合理的律师费用）、与死亡/人身伤害/资产损失相关的各种性质或类型的赔偿责任（统称“索赔”）进行赔偿，使这些“被免责方”不遭受任何损失，包括但不限于：与盗窃、设备损害、阶段性或永久性残疾有关的“索赔”，与提供急救、医疗服务、治疗或医疗决定有关的“索赔”（包括在比赛地或其他地方），医疗或住院费用的“索赔”，以及全部或部分由于“被免责方”的疏忽大意而引起的“索赔”。“被免责方”包括：赛事组委会、铁人三项赛的所有赞助商、铁人三项赛的生产商、铁人三项赛的工作人员、管理人员、官员、合同签约商、供应商和组织者（包括赛事总监）、志愿者、与铁人三项赛有关的所有其他人员或单位、铁人三项赛或部分铁人三项赛举办所在的城市、城镇和其他政府机构所在地，以上所提各方的官员、董事、雇员、代理、保险商以及其他参赛者和代表（以上各方统称“被免责方”）。

如果因出现紧急情况（如受伤或生病）需要进行医疗急救，我特此授权医务人员对我进行救助。

我在此进一步授权和许可赛事组委会及其被许可方在任何广播、电视广播、商业广告、宣传或铁人三项赛的其他宣传中使用我的姓名、声音、照片或图像，并可对我进行摄影、摄像并出售包含我肖像的照片、图像。我在此进一步放弃由于该等“使用”我原本有权享有的一切报酬或补偿。

我同意以下退赛及退款约定：我知晓报名成功后，赛前14天以上（10月26日前）进行退费申请，将扣除50%手续费，赛前14天以内（10月26日后）不进行退费，如遇特殊情况,将申请资料提交至组委会官方联系邮箱进行审核service@challenge-xiamen.com，审核完成后进行处理。比赛不设名额保留，且不可因任何原因将自己的名额转让、出售或赠送给他人。若违规将被立即退赛，报名费将不退还，也将被禁止参加未来的Challenge Xiamen 厦门铁人三项公开赛。

代表未成年人、无行为能力人和/或精神障碍人（以下称“特殊人群”）签署本协议的“特殊人群”的父母或法律监护人在此确认，其具有完全的法律权利和权力代表“特殊人群”签署本协议，并使之受本协议的法律约束。签署本协议的父母或法律监护人在此同意，对于因其不具有充分的法律权利或权力代表“特殊人群”签署本协议而使“被免责方”遭受的一切费用、索赔、或因此承担的责任，签字的父母或法律监护人将对“被免责方”进行全额的赔偿，使之不承受任何损失。

本协议构成各方就这些问题所达成的全面约定，除本协议外，没有其他口头声明、陈述或约定。若本协议的任何部分根据法律是不合法的、无效或由于任何原因不能执行，则该部分应视为从本协议中剔除，且不影响本协议其他条款的有效性和可执行性。

我在此保证，我已经仔细阅读本协议，并且理解本协议的所有条款和条件。我在此确认我将通过签署本协议而放弃我的实质性法律权利（包括我的未成年人、配偶、孩子、父母、监护人、继承人和最近血亲、以及任何法律代表和个人代表、执行人、管理人、继承人和受让人的权利）。我确认，我是自主自愿地签署本协议，我的签字没有受到任何外部的引诱、保证和担保。我在此签字表示全面且无条件地接受本协议的所有条款、条件和规定。

本人特此同意接收有关厦门体育产业集团赛事运营有限公司或承办的其它活动的信息。

WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

WARNING: READ CAREFULLY. THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHT AND DEPRIVES YOU OF THE RIGHT TO SUE ORGANIZING COMMITTEE; AND OTHER PARTIES. DO NOT SIGN THIS AGREEMENT UNLESS YOU HAVE READ IT IN ITS ENTIRETY. SEEK THE ADVICE OF LEGAL COUNSEL IF YOU ARE UNSURE OF ITS EFFECT.

In consideration of organizing committee allowing me to participate in the CHALLENGE XIAMEN and in related activities (e.g., course tours, Fitness Expo, etc.) scheduled to take place at the Tongan Romantic coast of Xiamen, during the period Nov 9-10, 2024, (the “Triathlon”), I, for myself, and on behalf of my spouse, children, parents, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby agree to and make the following contractual representations pursuant to this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement (the “Agreement”).

I agree that it is my sole responsibility to determine whether I am sufficiently fit and healthy enough to safely participate in the Triathlon, and I attest and certify that I am or will be sufficiently fit and physically trained to participate in the Triathlon which I elect to enter. I have no physical or medical condition which would endanger myself or others if I participate in the Triathlon, or would interfere with my ability to safely participate in the Triathlon. I understand and acknowledge the dangers associated with the consumption of alcohol and/or drugs before, during and after the Triathlon and I recognize that consumption of alcohol and/or drugs might impair my judgment and/or motor skills. I assume full responsibility for any injury, loss or damage associated with my consumption of alcohol and/or drugs.

I understand and acknowledge the physical and mental rigors associated with triathlons, duathlons, or other multi-sport events, and realize that running, bicycling, and swimming and other portions of such events are inherently dangerous and represent an extreme test of a person’s physical and mental limits. I understand that participation involves risks and dangers which include, without limitation, the potential for serious bodily injury, permanent disability, paralysis and death; loss or damage of property; exposure to extreme conditions and circumstances; accidents, illness, contact or collision with other participants, spectators, vehicles or other natural or manmade objects; dangers arising from adverse weather conditions; imperfect course conditions; water, road and surface hazards; equipment failure; inadequate safety measures; participants of varying skill levels; situations beyond the immediate control of the Triathlon Organizers; and other undefined harm or damage which may not be readily foreseeable, and other presently unknown risks and dangers (“Risks”). I understand that these Risks may be caused in whole or in part by my own actions or inactions, the actions or inactions of others participating in the Triathlon, or the acts, inaction or negligence of the Released Parties defined below, and I hereby expressly assume all such Risks and responsibility for any damages, liabilities, losses or expense which I incur as a result of my participation in the Triathlon.

I agree to be familiar with and abide by the Rules and Regulations established for the Triathlon, including but not limited to the Competitive Rules adopted by Yanqing. I agree that prior to participating in the Triathlon, I will inspect the race course, facilities, equipment, and areas to be used, and if I believe or become aware that any are unsafe, I will immediately advise the Race Director. I also accept sole responsibility for my own conduct and actions while participating in the Triathlon, and the condition and adequacy of my equipment.

I hereby release, waive and covenant not to sue, and further agree to indemnify, defend, and hold harmless the following parties: Organizing Committee; Xiamen Sports Industry Group Event Operation Co., Ltd; all Triathlon sponsors; Triathlon producers; Triathlon staff; administrators; officials; contractors; vendors; and organizers (including Race Directors); volunteers; all other persons or entities involved with the Triathlon; cities; towns; and other governmental bodies and locations in which the Triathlon or portions of the Triathlon take place; and the officers; directors; employees; agents; insurers; other participants and representatives of all of the above (collectively, the “Released Parties”), from any and all claims, causes of action, damages, losses (economic and non-economic), expenses (including court costs and reasonable attorneys fees) and liabilities of any kind or nature (collectively “Claims”), for death, personal injury, or property damage, which may arise out of, result from, or relate to my participation in, or my traveling to or from the Triathlon (including shuttle to/from airport/hotel and to/from the Triathlon), including but not limited to any Claims for theft, damage to any equipment, partial or permanent disability, Claims relating to the provision of first aid, medical care, medical treatment, or medical decisions (at the Triathlon site or elsewhere), Claims for medical or hospital expenses, and any including Claims caused in whole or in part by the negligence of the Released Parties.

Should the need arise for immediate medical treatment of an illness or injury; I hereby authorize emergency medical treatment for me by appropriate personnel without delay.

I further grant to Organizing Committee, Xiamen Sports Industry Group Event Operation Co., Ltd, and their licensees the right, permission, and authority to use my name, voice, picture, or photograph, in any broadcast, telecast, commercial advertisement, promotion, or other account of the Triathlon, and to photograph, shoot video of me and sell pictures or photographs containing my likeness, and I waive any rights to future compensation to which I might otherwise have been entitled for such use.

I agree to the following cancellation and refunding policy: The race registration is non-refundable. I also acknowledge that there is no deferral for race registration and transfer, resale or gifting of registration is not allowed at any time for any reason, and in violation of the forgoing, registration fee will not be refunded and I will be disqualified immediately and will be banned from future Triathlon.

The parent or legal guardian who signs this Agreement on behalf of a minor, incapacitated and/or mentally challenged person (hereinafter “Said Person”), hereby acknowledges that he or she has the legal capacity and authority to act on behalf of Said Person to legally bind Said Person to this Agreement. The parent or legal guardian who signs this Agreement agrees to indemnify and hold harmless the Released Parties from any expenses incurred, Claims made, or liabilities assessed against them, as a result of any insufficiency of legal capacity or authority to act on behalf of Said Person in the execution of this Agreement.

This Agreement represents the complete understanding between the parties regarding these issues and no oral representations, statements or inducements have been made apart from this Agreement. If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provision.

I hereby warrant that I have read this Agreement carefully, understand its terms and conditions, acknowledge that I will be giving up substantial legal rights by signing it (including the rights of the minor, my spouse, children, parents, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns), acknowledge that I have signed this Agreement freely and voluntarily, without any inducement, assurance or guarantee, and intend for my signature to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provision of this Agreement.

I hereby agree to receive information regarding other events organized or sponsored by Xiamen Sports Industry Group Event Operation Co., Ltd.
